§ 1 Scope and Contracting Party
(1) These General Terms and Conditions ("GTC") apply to all contracts for the purchase of artworks (originals, limited Giclée editions, small series) via the online shop marccroessmann.com, concluded between you and
Marc Crössmann, Darmstadt, Germany ("Seller").
(2) These GTC apply both to consumers and to business customers, unless a distinction is made below.
§ 2 Conclusion of Contract
(1) The presentation of artworks in the shop does not constitute a legally binding offer, but a non-binding invitation to the customer to submit an order.
(2) By clicking the order button ("buy now" or similar), you submit a binding offer to purchase.
(3) The purchase contract is concluded once I confirm your order by email or ship the goods.
§ 3 Nature of the Goods
(1) The items offered are predominantly handmade one-of-a-kind works (original paintings) as well as limited Fine Art Giclée editions, some of which are hand-finished (e.g., with acrylic or oil stick).
(2) Due to the handcrafted production and individual finishing, slight deviations from images shown in the shop may occur (e.g., in brush texture, material application, or signature placement). This does not constitute a defect.
(3) Color representation on screens may vary slightly from the original depending on the device and calibration, particularly for reds, blues, and greens.
(4) For limited editions, the total edition size and the edition number of the respective piece are stated in the product description.
§ 4 Prices and Payment Terms
(1) The prices shown in the shop at the time of order apply.
(2) In accordance with § 19 UStG (German small business regulation), I do not charge or show value added tax. The stated prices are therefore final prices.
(3) Payment is made via the payment methods offered during checkout (e.g., credit card, PayPal, and other methods offered via Wix Payments).
(4) For deliveries outside the EU (in particular to Switzerland and other non-EU countries), additional import duties, customs fees, or local taxes may apply, which are to be borne by the buyer and are not included in the stated price.
§ 5 Delivery and Shipping
(1) Delivery is made to the shipping address provided by the customer.
(2) Due to the uniqueness of the works and/or limited edition sizes, delays may occur in the event of high demand; I will inform you promptly in such cases.
(3) Shipping is carried out carefully packaged and, where possible, insured.
(4) The risk of accidental loss or damage passes to consumers only upon handover of the goods to the customer; for business customers, it passes upon handover to the carrier.
§ 6 Retention of Title
The delivered goods remain my property until payment has been received in full.
§ 7 Warranty
(1) Statutory warranty rights apply.
(2) Deviations as described in § 3 (2) and (3) of these GTC do not constitute a material defect.
(3) For business customers, the warranty period for used or individually produced goods is, to the extent legally permissible, 12 months from delivery.
§ 8 Liability
I am liable without limitation for intent and gross negligence, in accordance with the Product Liability Act, for injury to life, body, or health, and for breach of material contractual obligations ("cardinal obligations"). In the event of a slightly negligent breach of cardinal obligations, liability is limited to the foreseeable damage typical for this type of contract. Liability is otherwise excluded.
§ 9 Copyright
The purchase of an artwork includes only ownership of the physical piece, not the copyright or any rights of use/reproduction thereto. These remain with the artist unless expressly agreed otherwise in writing.
§ 10 Dispute Resolution
The European Commission provides a platform for online dispute resolution: https://ec.europa.eu/consumers/odr/. I am not obliged and not willing to participate in dispute resolution proceedings before a consumer arbitration board.
§ 11 Final Provisions
(1) The laws of the Federal Republic of Germany apply, excluding the UN Convention on Contracts for the International Sale of Goods (CISG). For consumers, this applies only insofar as it does not deprive them of protection granted by mandatory provisions of the law of the country in which the consumer has their habitual residence.
(2) If the customer is a merchant, a legal entity under public law, or a special fund under public law, the place of jurisdiction is Darmstadt, Germany.
